AUGUSTA (WJBF) – District Attorney, Jared Williams, says new evidence calls for the dismissal of charges against 3 people previously accused in the death of a 3-month-old.
Bennie Nash, Lamisha Seright, and September Seright, were accused of Malice Murder and Felony Murder for the death of Josiah Seright.
The infant was transported from the Budget Inn on Gordon Highway to Wellstar / MCG by EMS after being found unresponsive in August of 2024.
The facts originally presented to the DA’s Office and the Grand Jury indicated the child’s
death was caused by hypothermia after Josiah was left in wet car seat, wrapped in a wet blanket next to an air conditioning unit set to 61 degrees.
After receiving the completed Autopsy Report from the GBI and reviewing additional
medical records, the evidence does not support the murder charges. While the autopsy lists the
cause and manner of death as undetermined, the temperature of the child was greater than 95
degrees Fahrenheit at the time of his discovery, ruling out hypothermia as a cause of death.
The DA says Josiah did not die of hypothermia, the evidence no longer establishes a link between the defendants’ actions and the child’s death.
