A MAJOR update has been issued on the car finance commission scandal with a mammoth compensation bill expected.
The UK’s motor finance industry is bracing for a potential multi-billion pound compensation bill as the Financial Ombudsman Service (FOS) grapples with a surge in complaints related to commission practices.

Over 60,000 complaints are awaiting resolution – a staggering threefold increase since May 2024 – highlighting a potential scandal that could rival the infamous Payment Protection Insurance (PPI) debacle.
The investigation focuses on past practices where banks allowed car dealerships and brokers to set their own interest rates on loans.
Under a now-banned discretionary commission arrangement (DCA), dealerships and brokers had a financial incentive to charge higher interest rates, as their commission increased proportionally.
However, many customers were unaware of this practice.
As a consequence, individuals who financed the purchase of cars, motorbikes, or vans before 28 January 2021 – when DCA was prohibited – could be entitled to substantial compensation.
James Dipple-Johnstone, interim chief ombudsman at the Financial Ombudsman Service (FOS), appeared before the Treasury Committee today to discuss the scale of these complaints and how they compare to the PPI scandal.
He told MPs: “We’ve got over 60,000 cases with us relating to motor finance commission.
“So it is quite a significant block of work, which is why we’ve put a team onto it, not just to leave it there until the courts decide what they’re going to decide, but to start to prepare it so we can move it through quickly.
“Because we’ll have to be dealing with that next year and the year after.”
This ruling declared it unlawful for car dealers, acting as brokers, to receive commission from lenders without the fully informed consent of the customer.
This applies to both discretionary commission arrangements (DCAs), where dealers set interest rates, and non-discretionary commissions.
The appeal, brought by Close Brothers and FirstRand Bank, carries significant implications for the motor finance industry.
Should the Supreme Court uphold the Court of Appeal‘s decision, lenders could face a mammoth compensation bill, estimated to exceed £30billion.
Asked how motor finance complaints compare with the scale of PPI, Mr Dipple-Johnstone said: “Obviously the service saw a lot more during PPI but there was a wider selling of that kind of product.”
He said colleagues had said of the PPI scandal: “It was a slow burn, then it increased quite dramatically, and then the service cleared the work through.
“So what we’ve tried to do is learn from that event, prepare our ground, make sure we’ve got the training in place, we can scale up our resources quickly, we understand the product, we’ve got the legal advice, we’ve got the digital platforms to deal with the cases, so that if they do come through to us, we’re able to scale up quickly, so we can provide the best service we can to customers.”
According to the FCA, on a typical £10,000 motor finance agreement, discretionary commission arrangements could have caused customers to pay an additional £1,100 in interest over a four-year term.
In anticipation of the financial fallout, several major lenders have already set aside substantial funds.
Lloyds Banking Group has allocated £450million to cover potential fines, while Santander announced last year that it had reserved £295million for possible payouts.
Close Brothers, meanwhile, has opted to withhold dividends to investors and has taken steps to bolster its balance sheet by up to £400 million.
What is the FCA investigating and who is eligible for compensation?
The FCA announced in January, 2024 that it would investigate allegations of “widespread misconduct” related to discretionary commission agreements (DCAs) on car loans.
When you buy a car on finance, you are effectively loaned the value of the car while you pay it off.
These loans have interest payments charged on top of them and are often organised on behalf of lenders by brokers – usually the finance arm of a dealership.
These brokers earn money in the form of commission – a percentage of the interest payments on the loan.
DCAs allowed brokers to, to a certain extent, increase the interest rate on a loan, which in turn increased the amount of commission they received.
The practice was banned by the FCA in 2021.
Who is eligible for compensation?
The FCA estimates that around 40% of car deals may have been affected before 2021.
There are two criteria you must meet to have a chance at receiving compensation.
First, you must be complaining about a finance deal on a motor vehicle (including cars, vans, motorbikes, and motorhomes) that was agreed upon before January 28, 2021.
Second, you must have bought the vehicle through a mechanism like Personal Contract Purchase (PCP) or Hire Purchase (HP), which make up the majority of finance deals and mean you own the vehicle at the end of the agreement.
Drivers who leased a car through a Personal Contract Hire, where you give the car back at the end of the lease, are not eligible.
PROGRESS OF FCA INVESTIGATION
The FCA had initially planned to publish the results of its investigation in September, but this has now been postponed to May 2024.
Additionally, firms now have until December 4, 2025, to respond to customer complaints.
The FCA says it has had to push back the deadline due to it taking “longer than expected to get the data” it needed from implicated car finance firms.
Investigators have also been unable to complete their review because of a pending court case surrounding one of the complaints.
It’s worth nothing, the FCA’s decision to extend the deadline to December 4 next year is just when firms have to have respond to any complaints.
Customers are still encouraged to file their complaints before this date, and in some cases, there are specific time limits for doing so.

HOW TO CLAIM
Consumer finance website MoneySavingExpert.com offers an email template to help you complain to your finance provider.
You can download this by visiting moneysavingexpert.com/reclaim/reclaim-car-finance.
Alternatively, you can complain directly without using the template.
It’s crucial for anyone who took out car finance to file a claim, even if a previous claim was denied.
In your complaint, ask whether you were overcharged due to your broker receiving a commission and request the company to rectify this if it occurred.
If you’re unsatisfied with the company’s response, you can escalate your complaint to the Financial Ombudsman Service (FOS) at no cost.
You have until July 29, 2026, or up to 15 months from the date of the company’s final response letter, whichever is longer.
Avoid using a claims management firm, as they will take a portion of any successful claim.
The club is fifth in the Eredivisie, 12 points behind leaders Ajax.

A 483-YEAR-OLD castle that’s survived countless wars could soon be cut off from the UK.
Located in Hampshire, Hurst Castle was built by Henry VIII in the 1540s, becoming one of the most advanced artillery fortresses in England.

Managed by English Heritage, the Tudor castle remains popular with visitors who can even see the Isle of Wight on a clear day.
Despite its popularity with holidaymakers, Hurst Castle could soon be cut off from the mainland under new beach protection plans.
The rewilding plans have been drawn up by the Environment Agency, aiming to protect a mile-long stretch of the shingle coast against the impacts of climate change.
Expected to cost up to £16million, the new plans involve creating embankments that will allow the land to flood.
The land will then transition into a salt marsh over time, with other areas being left to take on a “more natural form”.
However, critics have spoken out against the plans, which they believe could see the 16th-century castle cut off from the mainland.
One campaigner, Dominic May, who is part of a group called Save Lymington and Keyhaven (Slak), said: “Keyhaven river will be changed beyond all recognition, Hurst Castle will be cut off permanently from the shore.
“There will not be any place to shelter under Hurst as the swell and waves will pass over Hurst shingle bank, and Lymington Harbour as a whole will be at risk.
“All of the features in that area will be given up to allow the tidal waters to migrate inland and create new intertidal habitat for the birds.”
The plans are still under consultation, with nothing confirmed.
Closed for the winter, Hurst Castle is set to reopen for its summer season on April 1.
Built by Henry VIII, the castle commanded the narrow entrance to the Solent – a major shipping lane for passenger, freight and military vessels.
The castle was used as a prison in the 17th century, with King Charles I holed up inside its walls.
Hurst Castle underwent significant modifications during the 19th and 20th centuries to adapt to evolving military technology, with armoured wings added to accommodate heavy artillery.
It also played an important role during the Second World War, serving as part of the country’s coastal defence network.
Nowadays, Hurst Castle is managed by English Heritage with visitors able to learn more about its role in defending England‘s southern coast.

The castle has been praised by visitors, with a 4/5 star rating from over 1,400 reviews.

WILLIE MULLINS will field a five-star line-up in his bid for a third Mares’ Chase at the Cheltenham Festival.
His attack will be fronted by 5-2 ante-post favourite Dinoblue, who was an agonising second 12 months ago.

She warmed up for the race with a game win over Allegorie De Vassy, who will also be part of Mullins squad.
She was only fourth last year, but the 7-1 shot was second in 2023 and is a danger to all if on her a-game.
Mullins said: “Dinoblue and Allegorie De Vassy went a great gallop the last day and there was no hiding place, despite there only being the two of them involved.
“I imagine they will reoppose at Cheltenham. I’m very happy with both of them and they will meet off levels at Cheltenham. It will be interesting.”
The unexposed one is Spindleberry, whose jumping was hit and miss on chase debut at Thurles.
This would be a huge step up in grade for the lightly raced eight-year-old, but there could be any amount of improvement from the 16-1 poke.
After her win, jockey Paul Townend said: “Spindleberry was really brave for me at the last – she jumped super.
“She took a blow and will come on for it, and she’ll go on a touch slower ground. I thought it was a good performance.”
His final two entries are Judicieuse Allen (33-1) and Hauturiere (100-1), who both need a big step up on what they’ve achieved over fences.
The five-some won’t have an easy time of it, however, with the well fancied Bioluminescence looking to have standout claims.
She jumped beautifully to make a winning chasing debut and built on that when second to Grade 1 winner Dancing City.
That form stands out, especially as it was against the boys, and she’s currently at 3-1.
Gavin Cromwell has another pair of excellent chances in the race, including last year’s winner Limerick Lace.
She has been nowhere near her best this season, including a heavy defeat behind Allegorie De Vassy, but this is likely to have been the plan all along.
Only By Night is the final of the big contenders, a Grade 2 winner this season who won snugly at Exeter last time.

The couple moved to the French hamlet almost a decade ago and got married in 2023.
Local mayor Jean-Sebastien Orcibal who officiated their wedding said he believes the deaths could be linked to “problems from the past”.
Mr Orcibal, who also happens to be the couple’s neighbour, told Sky News: “It doesn’t seem like the problem comes from here. They were very happy, very friendly and didn’t seem to have any problems.
“The problem seems to come from the past or somewhere far away.”
Speaking from the room in which he married Andrew and Dawn in September 2023, Mr Orcibal added: “I knew them as well because we were neighbours as I live in Pesquies as well.
“We got to socialise. They were very well integrated in the area.”
Post mortems into the tragic deaths were set to be carried out on Monday to confirm how they died.
Nicolas Rigot-Muller, the Rodez prosecutor in charge of the investigation, confirmed the autopsies were set to be held in Montpellier – but details won’t be released until a press conference at 5pm on Tuesday.
He said on Monday: “Today, the autopsies are taking place. It’s very open.
“It’s far too early for me to say anything, we have to keep our eyes peeled.
“We’re not favouring any direction at the moment. I cannot say if we’re looking for someone.”
Confirming no arrests have been made, he said: “Both died violent deaths, but I cannot yet firmly establish homicide.”
One investigation into the deaths is said to be centring on the husband’s money problems.

They said: “Money difficulties can often be the cause of much wider problems and that’s why finances are a key part of the inquiry.”
Andrew, a retired financial crime investigator, reportedly used a pension lump sum to buy their home in Les Pesquiès, south west France.
It came as detectives were uncovering “vital clues” about the couple’s final hours from trawling through their mobile phones.
Andrew’s mobile device is proving “particularly helpful”, according to one detective, after he was spotted making animated calls in previous days.
An investigating source said: “There is a mine of information and recent calls made by Mr Searle which are providing vital clues.”
One line of inquiry is whether it was a possible murder-suicide.
Others include abotched burglaryor a hitman linked to Andrew’s anti-fraud work with British banks Standard Life and Barclays.
CCTV footage from a local news agency caught Andrew’s last sighting, the day before the couple were found dead.
He was seen buying two lottery tickets and a bar of chocolate on Wednesday, shortly before 6pm.
The shopkeeper who served Andrew, Isabelle Palazy, 58, shared details about her interaction with the Brit.
She said: “I just couldn’t believe it when I heard the news. He and Dawn were regular customers. He would come in every day and buy Fortuna Blue cigarettes.
“That day he came in just before I was closing and he seemed perfectly happy, he was relaxed and he chatted and bought some chocolate and two lottery tickets.
FAMILY’S PAIN
Andrew’s heartbroken father, Fred Searle, 88, said he has been left with “thousands of questions” following the shock news.
Fred flew to Toulouse on Saturday, near his son’s home, as he wanted to bring the whole family together.
The former British Army major from Littlehampton, West Sussex, said: “We’ve got thousands of questions and very few answers.”
Andrew and Dawn were labelled by local friends as being a “popular” and “happy couple”.
Family friend, Odile Marian said: “They never talked about threats. They were not hiding. They were not feeling threatened.
“I don’t know anyone who didn’t like the couple – it would be impossible not to appreciate them.”

Walcott picked out the home teams, while Scott was on hand to draw the away sides.
As the draw was about to end, Scott was given the task of grabbing the final ball, which was the No. 6 of Ipswich.
When she read out the number, Somers stated: “And the last ball should be… Ipswich Town.”
The short delay sparked a moment of panic for Scott, who was worried that the trio had gone wrong somewhere.
The former right-back looked on confused and placed her hand to her chest as she exclaimed: “Oh, you scared me then. I was like, what?”
Walcott and Scott burst into laughter as they realised there had been no embarrassing faux pas, as fans called the rest of it a fix.
And Somers reassured the duo: “Perfectly done – do not worry.”

A SOLDIER who took her own life after “sexual harassment” from her boss was also pinned down by a senior officer who tried to kiss her, an inquest heard.

The 19-year-old was subjected to an “intense period of unwelcome behaviour” from Bombardier Ryan Mason, an inquest heard.
A service inquiry report published in October 2023 found this was almost certainly a “casual factor” in Jaysley’s death.
The court heard today how Jaysley was also allegedly targeted by another senior colleaguer, Battery Sergeant Major Michael Webber.
She called her pal, Lance Bombardier Kirsty Davis, in the early hours of July 2021 after staying at Thorney Island, near Emsworth in Hampshire, for a training exercise.
Lance Bombardier Davis said Jaysley told her that “something happened that night, they were all having a few drinks, someone tried it on with her”.
She said that the officer “was trying to kiss her and she was trying to push him away, he was pinning her down”.
The inquest heard Jaysley had called Lance Bombardier Davis from her car and that Webber had “tried to force himself on her more than once”.
Lance Bombardier Davis said: “I do not know if he actually kissed her or tried to, I do not remember if Jaysley said he had touched her or not.
“Jaysley was in tears, she was upset. I think she was just frightened at what was going on and she was crying, just a little bit.”
The court heard that Webber, who is now at Warrant Officer 2 rank, was made subject to a “minor sanction” after Jaysley made a complaint and he wrote a letter of apology to her.
Lance Bombardier Davis told the hearing that Jaysley did not want to take the matter further so “nothing would happen to him or his job as she didn’t want to suffer any backlash from it”.
She added: “Jaysley wasn’t happy with what had happened but if you are in the Army and a lower rank no-one will believe you, especially against a higher rank.
“She didn’t want to get into trouble or cause a drama.”
The Army service inquiry report said the incident was “possibly a factor that may have influenced her failure to report other events that happened subsequently”.
The inquest heard yesterday how Jaysley received thousands of messages from Bombardier Ryan Mason, who she described as being “psychotic and possessive”.
In November alone – the month before Jaysley’s death – she received 3,600 messages from her senior colleague.
In one, he told her: “You’re amazing Jayse, I appreciate you so much, I love everything about you, even your flaws.
“I will always be there along for the ride with you, I have said it before but you’re stuck with me forever now. I love you x As a friend, I love you.”
On November 25, Jaysley told Mason: “This whole falling in love with me, its becoming a bit too much, I have just come out of a relationship and I’m just not wanting to be involved in anything like this.
“It’s weighing me down a little bit, I’ll be totally honest with you.”
She added: “Totally honest here, I just don’t want to hear how you feel about me.”
In another message, Jaysley wrote that she feared Mason was watching her.
She said: “When you said you seen me leave camp I was a bit taken back like are you watching me when you say things like ‘You’re there’ it’s just weird and the whole thing is just bizarre.”
‘CREEP’ FEARS
In another message sent 11 days before she died, Jaysley told Mason: “It’s snapping me, I have replied to you and in the space of a couple of minutes you sent three texts and tried to phone me.
“Can you understand why I think it’s a bit too much?”
Jaysley’s mum Leighann McCready told the court her daughter felt that Mason was “overstepping the mark of her friendliness” and was becoming a “creep”.
The mum said Jaysley called her on December 7 “upset and crying” as she worried that her boss had hacked her phone and was listening to her conversations.
The Army report outlined three “contributory factors” to Jaysley’s death – including the “significant strain” of a sexual relationship with a married colleague in the last few weeks of her life.
It also said that family issues, including a bereavement, were possibly a factor, as well as the breakdown of a relationship in November 2021.
The third mentioned an “unhealthy approach to alcohol, with episodes of binge drinking”.
It added that Jaysley had no diagnosed mental health conditions and had not sought welfare support from anyone in the Army.
The inquest continues.
