Dr Motsoaledi to withdraw cannabis and hemp food regulations ban

Dr Aaron Motsoaledi, Minister of Health, has announced plans to withdraw the proposed regulations that would have banned the sale, importation, and manufacture of foodstuffs containing cannabis and hemp.

Addressing Concerns Over Unregulated Imports

In a press statement, it was announced that President Cyril Ramaphosa met with Dr Aaron Motsoaledi on Tuesday, 25 March, to discuss concerns over unregulated foodstuffs containing hemp and cannabis.

During the meeting, Dr Motsoaledi warned that, without proper oversight, these products could pose health risks, particularly to minors.

He emphasised that additional regulations are necessary to address these risks as such products continue to enter the market unchecked.

Withdrawal of Proposed Regulations

Dr Motsoaledi plans to revise the proposed regulations under the Foodstuffs, Cosmetics, and Disinfectants Act.

The original regulations aimed to prohibit the sale, importation, and manufacture of foodstuffs containing hemp and cannabis.

However, the Minister stressed that further discussions are needed before finalising any rules.

The Department of Health will continue broad consultations before publishing the revised regulations.

Ramaphosa: Cannabis and Hemp Sectors Key to Job Creation

In his February 2025 State of the Nation Address, President Cyril Ramaphosa emphasised the potential of the cannabis and hemp sectors to revitalise South Africa’s agricultural industry.

He highlighted that these sectors could play a crucial role in creating jobs, especially in rural areas with high unemployment.

Ramaphosa stated that the government aims for South Africa to become a leader in the commercial production of hemp and cannabis.

“We can add modern value to it and make it available on shelves worldwide.”

The newly passed law bans the sale, manufacture, or importation of food products, whether processed or unprocessed, containing any part of the Cannabis sativa plant.

This includes hemp seed oil or powder derived from it, as well as its various species or subspecies.
